These Terms of Service (the "Terms") are an agreement between you and SOUTH BEACH LLC ("we," "us," or "our") and govern your use of southbeachrecipes.com, our recipe club membership, our kitchen shop and any related services (together, the "Services"). Please read them carefully. Our Privacy Policy, Cookie Policy, Refunds & Money-Back Guarantee and Disclaimer are part of these Terms.
1. Acceptance of these Terms
By accessing or using the Services, creating an account, starting a free trial, becoming a member or placing an order, you agree to these Terms. If you do not agree, please do not use the Services. If you use the Services on behalf of an organization, you confirm that you have authority to accept these Terms for that organization.
2. Eligibility
You must be at least 18 years old, or the age of majority where you live, to create an account, start a membership or make a purchase. The Services are not directed to children under 13, and children under 13 may not use them. By using the Services, you confirm that you meet these requirements and that you are able to enter into a binding contract.
3. Your account
Some features, including membership, require an account. When you create one, you agree to:
- Give accurate and complete information and keep it up to date;
- Keep your password confidential and not share your account with anyone else;
- Tell us promptly at info@southbeachrecipes.com if you suspect unauthorized use of your account.
You are responsible for activity that happens under your account. Memberships are for personal, household use by the account holder. We may suspend or close accounts that break these Terms, as described in User conduct. You may close your account at any time by contacting us.
4. Membership, free trial and billing
Plans and prices
A South Beach Recipes membership unlocks the full recipe library and member features. We currently offer two plans:
- Monthly Membership: $8.99 USD per month.
- Annual Membership: $89.99 USD per year.
Prices do not include any sales tax that may apply where you live. The price shown at checkout is the price you will pay.
Free trial
New members get a 15-day free trial. We ask for a payment method when you start the trial, but you will not be charged during the trial. If you cancel before the trial ends, you will never be charged. If you do not cancel, your first payment for the plan you chose is billed when the trial ends. Free trials are limited to one per person and household.
Automatic renewal
Memberships renew automatically so your access is not interrupted. By starting a membership, you authorize us and our payment provider to charge your payment method:
- The plan price when your free trial ends; and then
- The plan price at the start of each new billing period (every month for monthly plans, every year for annual plans) until you cancel.
Your renewal date is always shown on your account page, so you can cancel before any renewal. If we change membership prices, we will give you notice before the new price applies to you, and you can cancel before it takes effect.
Cancel anytime
You can cancel at any time from your account page, or by emailing info@southbeachrecipes.com or calling +1 (940) 620-4575. When you cancel, no further charges will be made, and you keep member access until the end of the period you have already paid for. If you cancel during a free trial, access ends when the trial ends and you are not charged.
Payment issues
If a payment cannot be processed, we may try again and may pause member access until the payment method is updated. You can update your details from your account page. If you believe you were charged in error, please contact us first so we can fix it quickly.
5. Money-back guarantee
Both memberships and shop orders are covered by our 30-day money-back guarantee. If you are not happy for any reason within 30 days of your first paid membership charge (or an annual renewal charge), or within 30 days of receiving a shop order, contact us and we will refund you. 6. Shop orders, pricing and shipping
Orders
When you place an order, you are making an offer to buy the products in your cart. We will send an order confirmation email, and a contract is formed when we accept your order. We may decline or cancel an order, for example if a product is out of stock, if there is an obvious pricing error, or if we suspect fraud. If we cancel an order after you have been charged, we will refund you in full.
Pricing and product information
All prices are in USD. We work hard to describe and photograph products accurately, but colors and finishes can look slightly different on different screens, and occasional errors in descriptions or prices can happen. If we discover a pricing error before your order ships, we will contact you and let you choose whether to continue at the correct price or cancel for a full refund.
Shipping
We currently ship to addresses in the United States. Shipping is free on orders of $75 or more (based on the order subtotal before tax). Orders under $75 are charged a flat shipping rate of $6.99. Delivery estimates shown at checkout or in shipping emails are estimates, not guarantees. Title and risk of loss pass to you when the carrier delivers your package. If a package arrives damaged or goes missing, please contact us and we will make it right.
Returns
Returns and refunds for shop orders are covered by our Refunds & Money-Back Guarantee policy.
7. Intellectual property
The Services and their content, including recipes, recipe text, photographs, videos, articles, graphics, logos, the South Beach Recipes name, page design and software, are owned by or licensed to SOUTH BEACH LLC and are protected by copyright, trademark and other laws.
We give you a limited, personal, non-exclusive, non-transferable and revocable license to view and use the Services for your own non-commercial home cooking. You may print or save recipes for your personal use and share a link to a recipe page. Unless we give you written permission, you may not:
- Copy, republish, sell or distribute our recipes, photos or other content, in whole or in substantial part;
- Share member-only content with people who are not members, or share your login;
- Use automated tools such as bots, scrapers or crawlers to collect content or data from the Services, or use our content to train machine learning or artificial intelligence models;
- Remove copyright, trademark or other notices.
If you send us feedback, suggestions or recipe ideas, you allow us to use them without any obligation to you.
8. User conduct
You agree not to use the Services to:
- Break any law or violate the rights of others;
- Send spam, harassing, abusive, misleading or unlawful messages through our contact form or otherwise;
- Attempt to gain unauthorized access to accounts, systems or data, or interfere with the security or operation of the Services;
- Upload viruses or other harmful code;
- Place fraudulent orders, misuse free trials, or abuse the money-back guarantee through repeated or bad-faith refund requests;
- Impersonate any person or misrepresent your relationship with anyone.
We may suspend or terminate your access to the Services if you break these Terms. Where reasonable, we will tell you why and give you a chance to respond. Sections of these Terms that by their nature should survive termination will continue to apply.
9. Recipes and food safety
Our recipes are tested and written with care, but cooking results depend on your ingredients, equipment and technique. Nutrition information is an estimate. You are responsible for handling food safely, checking ingredients for allergens, and using kitchen equipment according to the manufacturer's instructions. Our content is not medical, nutritional or dietary advice. Please read our full Disclaimer before cooking.
10. Third-party links and ads
The Services may contain links to websites and services we do not own or control, and we advertise using Microsoft Advertising (Bing Ads). We are not responsible for the content, products, privacy practices or availability of third-party sites. Your use of them is at your own risk and subject to their terms. Our use of advertising technology is explained in our Privacy Policy.
11. Disclaimer of warranties
We want you to enjoy the Services, and we stand behind them with our money-back guarantee. Apart from that and any product warranty that comes with an item you buy, the Services and all content are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all other warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not promise that the Services will always be available, uninterrupted or free of errors, or that any recipe will produce a particular result. Some states do not allow the exclusion of implied warranties, so some of these exclusions may not apply to you.
12. Limitation of liability
To the fullest extent permitted by law, SOUTH BEACH LLC and its owners, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data or goodwill, arising out of or related to your use of the Services, even if we were advised of the possibility of those damages.
To the fullest extent permitted by law, our total liability for any claim arising out of or related to these Terms or the Services is limited to the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, or (b) one hundred US dollars.
Nothing in these Terms limits liability that cannot be limited by law, such as liability for gross negligence, willful misconduct, or death or personal injury caused by our negligence, and nothing limits your rights as a consumer that cannot be waived.
13. Indemnification
You agree to defend, indemnify and hold harmless SOUTH BEACH LLC and its owners, employees and agents from any claims, losses, liabilities and expenses, including reasonable attorneys' fees, arising from your breach of these Terms, your misuse of the Services, or your violation of any law or the rights of a third party.
14. Dispute resolution and governing law

Most concerns can be resolved quickly. Before starting any formal proceeding, please contact us at info@southbeachrecipes.com with a description of the issue and what you would like us to do. We will try in good faith to resolve it within 30 days.
Governing law
These Terms and any dispute arising out of or related to them or the Services are governed by the laws of the State of Florida, without regard to its conflict of laws rules, and by applicable federal law of the United States.
Venue
If a dispute cannot be resolved informally, you and we agree that it will be brought exclusively in the state or federal courts located in the State of Florida, and both parties consent to the personal jurisdiction of those courts. Either party may bring an individual claim in small claims court if it qualifies. Nothing in this section prevents you from contacting a government consumer protection agency.
Time limit
To the extent permitted by law, any claim must be brought within one year after it arises, or it is permanently barred.
15. Changes to these Terms
We may update these Terms from time to time. When we do, we will change the "Last updated" date above. If a change is material, for example a change to billing or renewal terms, we will give you reasonable advance notice by email or on the site. Changes do not apply to disputes that arose before the change. If you continue to use the Services after the changes take effect, you accept the updated Terms. If you do not agree, you can cancel your membership and stop using the Services.
General
If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not transfer your rights under these Terms without our consent; we may transfer ours in connection with a business transfer. These Terms, together with the policies referenced above, are the entire agreement between you and us about the Services.
