This Privacy Policy explains how SOUTH BEACH LLC ("we," "us," or "our") collects, uses, shares and protects personal information when you visit southbeachrecipes.com, join the South Beach Recipes recipe club, buy from our kitchen shop, or contact us (together, the "Services"). We have tried to write it in plain English. If anything is unclear, please get in touch.
1. Information we collect
We collect only what we need to run the Services well. The information falls into a few groups.
Account information
When you create an account or start a membership, we collect your name, email address and a password. Passwords are stored only as a one-way cryptographic hash, so we cannot see or recover the password itself. We also keep basic account records such as when the account was created, when you last signed in, your membership plan, trial dates, renewal dates and whether a membership has been canceled.
Order and payment information
When you buy a membership or place a shop order, we collect your name, email address, shipping address (for physical products), the items or plan you purchased, prices, shipping charges and order totals. Card details are handled by our payment provider. We keep only limited payment details, such as the card brand and the last four digits of the card, so that we can identify a transaction if you contact us about it. We do not store your full card number or security code.
Contact form and customer support
If you use our contact form, email us or call us, we collect your name, email address, the topic you choose, the content of your message and any details you decide to share, such as an order number. When a message is sent through our contact form, we also record the IP address it came from to help prevent spam and abuse.
Cookies, device and usage data
When you use the Services, we and our partners automatically receive certain technical information, such as your IP address, browser type, device type, operating system, referring page, pages viewed, and the date and time of your visit. We use a session cookie to keep you signed in and your browser's local storage to remember your shopping cart and your cookie choice. If you agree to advertising cookies, Microsoft Advertising (Bing Ads) may also collect information about your visit and actions on our site. See Cookies and similar technologies and our Cookie Policy for details.
2. How we use information
We use personal information to:
- Create and manage your account and give members access to the full recipe library;
- Start, renew and cancel memberships, including free trials, and process payments and refunds;
- Process, ship and track shop orders, and handle returns, exchanges and our money-back guarantee;
- Send transactional messages, such as order confirmations, shipping updates, trial reminders, renewal notices and account security alerts;
- Answer questions and provide customer support;
- Keep the Services secure, detect and prevent fraud, spam and abuse, and troubleshoot problems;
- Understand how the Services are used so we can improve recipes, products and site features;
- Measure the performance of our advertising and, where you allow it, show you relevant ads (see Advertising);
- Comply with legal obligations, enforce our Terms of Service, and protect the rights and safety of our customers, our company and others.
We do not use automated decision-making that produces legal or similarly significant effects about you.
3. Legal bases for processing
Where the law requires a legal basis for using personal information, we rely on one or more of the following:
- Contract: to provide the membership, orders and account features you ask for.
- Legitimate interests: to run, secure and improve the Services, prevent fraud and communicate with customers, in ways that do not override your rights.
- Consent: for advertising cookies and similar technologies. You can withdraw consent at any time without affecting processing that happened before.
- Legal obligation: to keep tax and accounting records, respond to lawful requests and meet other legal duties.
4. How we share information
We do not sell your personal information for money. We share it only as described below.
- Service providers. We work with companies that host our website and database, send email, provide customer support tools and help us keep the Services secure. They may use your information only to perform services for us and must protect it.
- Payment provider. Payment card details you enter at checkout are processed by our payment provider to complete purchases, renewals and refunds and to help prevent fraud. Our payment provider handles your card data under its own security and privacy obligations.
- Shipping carriers. For shop orders, we share your name, shipping address and, where needed for delivery updates, your email address with the carrier that delivers your package.
- Advertising partner. If you agree to advertising cookies, Microsoft Advertising (Bing Ads) receives information about your visit and actions on our site, as described in Advertising.
- Legal and safety reasons. We may disclose information if we believe in good faith that it is required by law, subpoena or other legal process, or is necessary to protect the rights, property or safety of our customers, our company or the public.
- Business transfers. If we are involved in a merger, acquisition, financing or sale of assets, personal information may be transferred as part of that transaction, subject to this policy.
- With your permission. We may share information for other purposes when you ask us to or agree to it.
5. Advertising
We advertise South Beach Recipes using Microsoft Advertising (Bing Ads). To understand whether those ads work, and, if you allow it, to show you more relevant ads, we may use the Microsoft Universal Event Tracking (UET) tag on our site.
How the UET tag works
The UET tag is a small piece of code from Microsoft. When it is active, it can record information such as the pages you visit on our site, the ad you clicked to get here, whether you started a free trial, joined as a member or completed a shop order, and technical details such as your IP address, browser and device. Microsoft may set or read cookies such as _uetsid, _uetvid and MUID to do this.
Conversion tracking
We use this information for conversion tracking: counting how many people who clicked one of our ads went on to take a meaningful action, like starting a membership or placing an order. Microsoft reports these results to us in aggregate. We use them to decide where to spend our advertising budget.
Interest-based advertising
Microsoft may also use the data collected by the UET tag, combined with other information it holds, to show you ads for South Beach Recipes on Bing, Microsoft properties and partner sites (sometimes called remarketing or interest-based advertising). Microsoft's use of this data is governed by the Microsoft Privacy Statement.
Consent first
We load the UET tag only after you click "Accept" in our cookie notice. If you choose "Decline," or make no choice, the tag is not loaded. You can change your choice at any time on our Cookie Policy page.
Your advertising choices
In addition to our cookie controls, you can use these tools to limit interest-based advertising:
- Microsoft personalized ad settings — turn off personalized ads from Microsoft.
- Network Advertising Initiative opt-out — opt out of interest-based ads from participating NAI members.
- YourAdChoices (Digital Advertising Alliance) — opt out of interest-based ads from participating companies.
- Microsoft Privacy Statement — learn how Microsoft handles advertising data.
Opting out does not mean you will stop seeing ads. It means the ads you see will be less tailored to your interests. Opt-outs are usually stored in a cookie, so if you clear cookies, change browsers or use another device, you may need to opt out again. We also honor the Global Privacy Control signal, described in US state privacy rights.
6. Cookies and similar technologies
We use a small number of cookies and browser storage items. Essential items, such as our session cookie, the shopping cart saved in your browser and the record of your cookie choice, are needed for the site to work and are always on. Advertising cookies from Bing Ads are used only if you accept them. Our Cookie Policy lists each item, what it does and how long it lasts, and explains how to change your choices.
7. Data retention
We keep personal information only for as long as we need it for the purposes in this policy, and then delete or de-identify it. As a general guide:
- Account information is kept while your account is open. If you ask us to close your account, we delete or de-identify account data within a reasonable time, except where we need to keep some records as described below.
- Order, membership and payment records are kept for as long as required for tax, accounting, warranty and legal purposes, typically up to seven years after the transaction.
- Contact form messages and support emails are generally kept for up to two years after the conversation ends, unless they relate to an order or a legal matter.
- Session cookies expire when you close your browser. Items in local storage stay until you clear them or, for your cart, until checkout is complete.
Data collected by Microsoft Advertising (Bing Ads) is retained according to Microsoft's own policies.
8. Security
We use reasonable administrative, technical and physical safeguards to protect personal information. These include encrypted connections (HTTPS), hashed passwords, secure and HTTP-only session cookies, restricted access to our database, and limited retention of payment details. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. Please use a strong, unique password and let us know right away at info@southbeachrecipes.com if you believe your account has been compromised. If a security incident affects your personal information, we will notify you as required by law.
9. Children's privacy
The Services are intended for adults and are not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe a child under 13 has given us personal information, please contact us and we will delete it. We do not knowingly sell or share the personal information of consumers under 16.
10. US state privacy rights
Residents of several US states, including California (under the CCPA as amended by the CPRA), Virginia, Colorado, Connecticut, Utah, Texas, Oregon and others with similar laws, have rights over their personal information. We extend the rights below to all US customers, regardless of where you live, subject to verification and to exceptions allowed by law.
- Right to know and access. You can ask what personal information we have collected about you, the sources, the purposes, and the categories of third parties we disclose it to, and you can request a copy.
- Right to delete. You can ask us to delete personal information we collected from you. We may keep information we must retain by law, such as transaction records.
- Right to correct. You can ask us to correct inaccurate personal information. You can also update your name and email in your account.
- Right to opt out of sale, sharing and targeted advertising. We do not sell personal information for money. However, allowing Microsoft Advertising (Bing Ads) to collect data through advertising cookies may count as "sharing" for cross-context behavioral advertising or "targeted advertising" under some state laws. You can opt out by declining advertising cookies, by using the opt-out links above, or by contacting us.
- Right to portability. You can ask for your information in a commonly used, portable format.
- Right to limit use of sensitive personal information. We do not collect sensitive personal information for purposes that would require this right.
- Right to non-discrimination. We will not deny you service, charge you different prices or give you a lower quality of service because you exercised your privacy rights.
- Right to appeal. If we decline your request, you can appeal by replying to our decision. If you remain unsatisfied, you may contact your state attorney general.
Global Privacy Control
We honor the Global Privacy Control (GPC) signal. If your browser or extension sends a GPC signal, we treat it as a request to opt out of the sale or sharing of personal information and of targeted advertising for that browser, and advertising cookies will not be loaded. Because GPC is tied to a browser, you may need to enable it on each browser and device you use.
Categories of information
In the past 12 months we have collected the categories of personal information described in Information we collect: identifiers (such as name, email address and IP address), customer records (such as shipping address and limited payment details), commercial information (such as purchases and memberships), and internet or network activity (such as pages viewed). We collect them from you directly, automatically from your device, and from our advertising partner, for the purposes described in How we use information, and we disclose them to the categories of recipients in How we share information.
11. How to exercise your rights
To make a privacy request, contact us by either method:
- Email: info@southbeachrecipes.com (please use the subject line "Privacy Request")
- Phone: +1 (940) 620-4575
Tell us which right you would like to use and include the email address associated with your account or orders. To protect you, we will verify your request by matching the information you give us with our records, and we may ask for more details if needed. You may use an authorized agent to submit a request on your behalf; we may ask the agent for proof of authorization and ask you to confirm your identity directly. We aim to respond within 45 days. If we need more time, we will let you know why and how long it will take.
12. International users
The Services are operated from the United States and are intended for customers in the United States. If you access the Services from outside the United States, your information will be transferred to, stored and processed in the United States, where data protection laws may differ from those in your country. Where applicable law requires it, we rely on appropriate safeguards for these transfers. If you are located in a region with its own data protection rights, you may contact us to exercise them.
13. Changes to this policy
We may update this Privacy Policy from time to time to reflect changes in our practices, the Services or the law. When we do, we will change the "Last updated" date at the top of this page. If a change is material, we will give you notice by email or by a notice on the site before it takes effect. Your continued use of the Services after the updated policy takes effect means you accept the changes.
